From the license at 17 years old to overtaking on the right on highways, many new features and revision proposals for the new highway code. The discussion between the Mit (Ministry of Infrastructure and Transport) regarding the Highway Code with operators and sector associations reveals some potential and important innovations with the aim of arriving at a text that is as close as possible to the needs of motorists.

Overtaking on the right
The revision proposals – illustrated by the ministry – are about fifteen and range from greater protections for the most vulnerable to crackdowns on uninsured vehicles as well as fines that are more proportionate and not oppressive. Among the possible new features, one stands out. Under study is also “the introduction of the rule of overtaking on the right on highways: it means applying parallel lane circulation on three-lane highways and expressways, which would allow overtaking on the right,” as explained by the Mit. For motorcyclists, the proposal – explains the ministry – is for “greater protections on highways and the possibility, in case of accidents or heavy slowdowns, to use the emergency lane, always ensuring the passage of rescue vehicles.” For pedal cycles, that is those vehicles also used for home deliveries, the obligation of helmet and badge is under study.”
License at 17 years old
Furthermore, it may no longer be necessary to be of legal age to obtain a license. Under study is the possibility of obtaining it already at 17 years old. And then a crackdown on those driving without insurance. The Mit states that “controls will be strengthened thanks to the Motorization databases by introducing the digital driving ban. In case of failure to regularize, at the first roadside check, seizure can be applied directly – warns the ministry -. Also in progress are measures to combat degradation and abandoned vehicles.”

Among the directives of the new highway code, making fines simpler and proportionate, that is “less oppressive,” “to the actual severity of violations, while at the same time providing for harsher penalties for uninsured vehicles,” explains the Mit.
Recovery of unpaid fines
Also under study is the “recovery of fines unpaid by foreigners within five years following the violation. In particular, the possibility of enforced collection against any driver found circulating in Italy with the vehicle with which the infraction was committed is envisaged.” And then the stop to the automatic increase of fines linked to inflation. Among the major innovations envisaged by the Mit, a strengthening of the appeal to the prefect and a more streamlined process to be able to cancel incorrect fines with shorter waits and greater guarantees are being studied. “Reduction from 90 to 30 days of the deadline for notification of reports related to remote checks.”
