Movimento Consumatori has launched a class action against Netflix, filing a complaint with the Court of Rome on July 20. The initiative aims to obtain reimbursement for the increases applied to subscriptions between 2017 and 2024, based on a ruling by the same Court which, last April 1, had judged the clauses allowing the platform to unilaterally modify prices to be illegitimate.
The contested increases and possible refunds
According to the association, the nullity of the clauses would make the four increases introduced during the period considered irregular. The figures are significant: an additional eight euros per month for the premium plan and four euros for the standard plan. Refunds, therefore, should be calculated based on the months in which the user paid an increased fee. Lawyer Corrado Pinna, who assisted Movimento Consumatori in the action, explained that the potentially involved audience is very large: between 5 and 6 million users, with individual refunds estimated between 250 and 500 euros, depending on the type of subscription.
The companies involved and consumer interest
The class action was brought against Netflix Italy Services, which has managed Italian subscriptions since 2022, and against Netflix International BV, responsible until 2021. The association reports that over 240,000 people have already expressed interest by filling out the online form available on the website. Movimento Consumatori openly criticizes the platform’s position: «After the ruling by the Court of Rome, Netflix stated that it takes consumer rights very seriously, but has not put forward any refund proposal and has appealed the decision to the Court of Appeal», reads the statement issued by the organization.

European precedents
The association’s lawyers, Pinna and Paolo Florio, also refer to similar cases in Europe: similar proceedings have been initiated or are pending in Germany, the Netherlands, Austria, and Poland. A picture that, according to Movimento Consumatori, confirms the relevance of the issue and the need for uniform protection for users of digital services.
