The rules for parking on blue lines are changing. While previously the delay in returning to a car parked on blue lines was handled differently depending on the Municipality; various rulings considered the expired ticket as a simple contractual breach, often applying an informal tolerance of 15 minutes.
Now, however, article 7 of the Highway Code has established a national rule valid for all. The tolerance threshold is no longer fixed but becomes a percentage and ‘elastic’, calculated directly on the parking time for which the ticket was purchased.

And to avoid mistakes, it is better to use smartphone apps (such as EasyPark, Telepass, and MooneyGo) to have the possibility to extend the parking remotely before the time expires or to interrupt it early, paying only for the actual minutes used.
Parking without a ticket, the new penalty arrives
The main novelty, as stated in the Official Gazette, concerns cases where the driver parks without paying the due amount. According to the new paragraph 14-bis of article 7 of the Highway Code “in order to allow the recovery of the unpaid fee, in the cases indicated in paragraph 14-ter, letters b) and c), the penalties provided are increased by an amount corresponding to the unpaid fee. The penalties and related increases apply for each twenty-four-hour period in which the violation continues.”
So those who do not pay for parking will not only receive a fine but will also have to pay the full daily rate of the zone where they parked. For example, in an area with paid parking from 8 am to 8 pm and a rate of 2 euros per hour, the extra amount will be 24 euros, to be added to the administrative fine of 42 euros.
Expired parking, tolerance is calculated as a percentage
For those who paid for parking but stay beyond the scheduled time, the new paragraph 14-ter introduces a distinction based on the overtime: within 10% of the paid time: no penalty. If you paid for two hours (120 minutes), you have a tolerance of 12 minutes; beyond 10% and within 50% of the paid time: a reduced penalty of 50% applies; beyond 50% of the paid time: the full fine applies, plus recovery of the daily rate.
Also in these cases, as already provided for non-payment, the amount of the unpaid daily rate is added to the penalty for each day of confirmed violation.
Fine for blue lines, when the 30% discount applies
The mechanism of a 30% discount on the fine amount if payment is made within 5 days of notification has been maintained. A measure aimed at encouraging quick payments and reducing disputes.
The three tolerance bands for parking beyond the paid time
The goal of the new rule is twofold: on one hand, to prevent abuse and ensure that those occupying a paid spot do so correctly, on the other, to introduce criteria of greater fairness, distinguishing those who exceed by a few minutes from those who completely ignore the rules. To determine the amount to be paid in case of overtime, the new system identifies three distinct situations.

1) Overtime within 10%: no fine
If the auxiliary’s check occurs within 10% of the paid time, no ticket is issued. If 2 hours of parking (120 minutes) were purchased, you have a 12-minute margin. If 1 hour (60 minutes) was paid, the tolerance drops to 6 minutes.
2) Overtime between 10% and 50%: half fine plus fee
If the delay is between one-tenth and half of the purchased time, a reduced penalty of 50% applies (21 euros instead of the base fine of 42 euros). However, this amount is added to the recovery of the unpaid fee for the extra time used.
3) Overtime beyond 50%: full fine plus fee
If the delay exceeds half of the paid period (for example, more than 30 minutes late on a purchased hour), the overtime is equated to non-payment: the full fine is paid (from 42 euros to 173 euros) plus the adjustment of the due fee.
Quick parking, only three minutes of tolerance
Things change for so-called quick parking. Those who purchase a ticket of only 30 minutes benefit from a tolerance margin of only 3 minutes. In this case, even a minimal discrepancy between the driver’s clock and the auxiliary’s handheld device can result in a ticket on the windshield.
Fine and fee recovery, two distinct amounts
The real structural novelty concerns the clear separation between the administrative penalty for not respecting the time and the recovery of the fee, i.e., payment for the use of public space. While previously there was often confusion by charging lump sums, the law now establishes that the unpaid parking fee must be recovered along with the fine, allowing Municipalities to collect both the monetary penalty and the corresponding amount due for parking.
Blue lines without a ticket, no tolerance
No discount for those who completely forget to use the parking meter. The percentage tolerance applies exclusively to those who made an initial payment that turned out to be insufficient. Those who leave the car on blue lines without displaying the ticket or without activating parking via app face the full fine of 42 euros, plus the recovery of the fee calculated for the entire duration of the parking.
