The future of beach concessions enters a decisive phase. The Council of State, with ruling 6539 of August 18, has set a precise deadline for the completion of the reassignment procedures: the tenders must be announced and concluded by September 30, 2027.

The decision intervenes in a case that has been dragging on for over sixteen years and recalls the competition principles established by European legislation.
Beach concessions, by when must the tenders be held
The administrative judges clarified that September 30, 2027 does not represent a new extension in favor of the current concessionaires. Instead, it is the maximum deadline granted to administrations to complete the public tenders necessary for the reassignment of the concessions.
The period available to the municipalities must therefore be used to organize and carry out the procedures, not to further postpone the application of competition rules.
The schedule set by the Council of State
According to the ruling, the concessions may remain effective until September 30, 2027. A further extension until March 31, 2028 will be possible only in the presence of exceptional and adequately justified circumstances.

For the municipalities, there are also precise deadlines. The calls for tenders must be published at least six months before the expiration of the concessions and, in the first application of the new rules, the administrations must in any case act by June 30, 2027. Failure to meet the deadlines may open the way to new appeals before the administrative judge.
Compensation, it will not be automatic
The ruling also intervenes on the position of the current concessionaires and on the issue of possible compensation.
The recognition, therefore, will not be automatic, but it will be necessary to demonstrate the existence of investments not yet amortized and destined to lose value precisely because of the termination of the concession.
